Possession of Site
The Engineer or its representative will handover the work site(s) may be from time to time to the contractor in accordance with the terms and conditions of the contract . These dates of possession of site must be clearly recorded , in particular of partial takeover . Notice to public should be posted at any ingress / egress of work site to notify the passers-by that there is construction work carrying on . Project signboards should also be erected at all main ingress / egress of site to illustrate the Project Title , site plan , the Client and the major parties concerned .

[ Construction DB Tips : The commencement date of contract may not be the same day to commence the Work on site . To commence the works on site all depends on the actual possession date(s) . Thus these dates must be clearly recorded particularly for partial takeover and better by way of consents in writing . ]

Possession of Access
The aforesaid “ Possession of site ” does not mean there is access reaching the job sites for work . For example , the Engineer hands over a borrow area to the Contractor however the captioned borrow area is sited behind a “ native village ” ( 原居民圍村 ) and the only vehicle access from the main road has to pass by their “ Chi Tong ” ( 祠堂 ) , ancestral graveyard ( 祖墳 ) or group of urns ( 骨灰龕) . The village representative ( 村長 ) on behalf of the native villagers protests that the future trafficking of construction vehicles beside their holy places will seriously affect their “ Fung Shui ” ( 風水 ) and only allows the workers to carry constructional equipments and materials by hand to the borrow area . Regardless of the contract conditions , it still requires timely negotiation with the villagers to settle the access problem and when worse comes to worst , new construction and subsequent reinstatement of temporary access road may be required for replacement . Thus the dates of gradual possession of access roads to work sites are critical for programming of Work and should be recorded .

[ Construction DB Tips : Someone thinks that the possession of access is only one of the hundred minor problems on site that eventually requires the Contractor to solve under the conditions of contract . However it does significantly affect the mass output of work , the record of these dates may bring you surprise benefits in the future dispute / claim . After all , the access problem should be firstly considered at the tender stage . ]
